PARTNER VISAS
Because love knows no borders
Partner Visa Options
The Australian partner visa program allows the spouse or de facto partner of an Australian citizen, permanent resident or eligible New Zealand citizen to live in Australia temporarily and eventually permanently.
In order to be eligible for a Partner visa, you must be in a genuine, ongoing, exclusive relationship and be able to sufficiently evidence this.
Depending on whether you are in or outside Australia at the time of applying, there are different subclasses available:
-
Subclass 820 and subclass 801 – for onshore applicants
-
Subclass 309 and subclass 100 – for offshore applicants
-
Subclass 300 – for engaged couples applying from overseas
1. Subclass 820 & 801 Partner Visa (Onshore)
The subclass 820 Partner visa is a temporary onshore Partner visa that allows you to stay in Australia while your permanent subclass 801 Partner visa is processed.
Subclass 820 Partner Visa (temporary):
-
You must apply while you are inside Australia
-
This visa allows you to stay, work and study in Australia while awaiting your permanent Partner visa
-
You can include dependent children in your application
Subclass 801 Partner Visa (permanent):
-
This is the permanent stage of the onshore Partner visa
-
It is typically processed two years after your initial application
-
You may be eligible for earlier grant if you are in a long-term relationship or have dependent children together

Subclass 309 – Temporary Partner Visa:
-
You must apply while you are outside Australia
-
You must also be outside Australia at the time of visa grant
-
The visa allows you to enter Australia, live with your partner, work and study while awaiting permanent residency
Subclass 100 – Permanent Partner Visa:
-
This is the permanent stage of the offshore Partner visa process
-
Generally considered approximately two years after the date of your initial application

Proving a Genuine Relationship
A significant part of any Partner visa 820 and 309 or Prospective Marriage visa application is demonstrating the authenticity of your relationship through a wide range of documentary evidence. As your Registered Migration Agent, we will step you through the entire process, giving you feedback on the evidence you have and suggesting ways to strengthen your application.
Each case for a Partner visa is different, and we work closely with you to ensure your evidence is well-prepared and compelling. Although no agent can ever guarantee an outcome, we will assess your case based on your individual circumstances and highlight any issues or points that need strengthening to give you the best possible chance at success.
Same-Sex Couples Welcome
We have helped numerous same-sex couples achieve their dream of obtaining a Partner visa 820 or 309 and living together in Australia permanently.
Australia legally recognises same-sex marriages and relationships, including for the purposes of all Partner and Prospective Marriage visas. Whether you are in a same-sex de facto relationship, you are married or engaged to be married, the gender or sex of your partner or spouse does not exclude you from being eligible for a Partner visa or Prospective Marriage visa.
We welcome and support same-sex couples with dignity, understanding and the same high level of service because everyone deserves to love and be loved.
